so, i was trying to find the actual article but all google took me to was this lame video http://www.cnn.com/video/#/video/bestoftv/2010/02/11/hln.jvm.issue.fl.woman.cnn

BUT MORE important the actual story was really detailed... there was SO much proof that this was getting stalked and the judge just blew it off. Restraining orders are one of the easiest things to obtain with minimal evidence I don't udnerstand why she wasn't granted one with phone calls/emails/physical stalking.

...but i really hate the video above... that lady irks me lol

Unless she's leaving something out to be more outrageous in her news reporting (likely), maybe someone could have a case brought against the judge due to that ruling. I'm not really sure what kinds of punishments judges could get, and I'm not sure if this warrants disbarment at all, but he shouldn't get away from this entirely scot-free.

i agree... the actual story was more informed then the rant from the lady above. I don't know what but she should have gotten the order...

If that's her normal reporting style then she couldn't convince me to continue breathing, let alone care about HER issues.

Screwed up situation though. Too bad it had to happen in my own backyard like that, too.

Orlando Sentinel's article on it (http://www.orlandosentinel.com/news/local/breakingnews/os-technology-park-double-shooting-20100209,0,905850.story)

The way the article notes everything, regardless if the judge gave her a restraining order. I highly doubt this situation would have changed.

"As a judge, you have to follow the law. You're not omniscient," Moxley said.I'm sure granting a restraint order isn't so life-changing that a simple apology couldn't undo the "damage" from a restraint order made in error. Definitely a case where erring on the side of safety could've prevented a couple unnecessary deaths.

I'm a little confused on that? are you saying the judge shouldn't be punished??

I'm saying the judge sounds like he was too concerned for saving face over the innocuous consequences of unfairly issuing a restraining order instead of actually hearing the well-documented case put in front of him and that because of this, he unnecessarily allowed a known stalker to pursue his victim to their respective deaths. In other words, the guy was attempting to save his own ass at the cost of this woman's personal safety and that I think he should get punished, although I think outright disbarment might be a little heavy-handed.

oh okay.. yea i don't think he'll just get fired... but probably a lawsuit filed against him and maybe a tap onthe wrist in the legal world... *sigh*
