Here's one for your "only in California" file: A judge has ordered (http://www.msnbc.msn.com/id/23258714) a Sunnyvale couple to cut down two of the eight redwood trees on their property because they block sunlight access to their neighbor's solar panels.
About six years ago, Mark Vargas complained that eight redwood trees on Richard Treanor's and Carolyn Bissett's property were blocking sunlight to the $70,000 worth of solar panels he built to power his house in 2001. To protect his investment, Vargas cited the obscure Solar Shade Control Act that requires homeowners to keep their trees from shading more than 10 percent of a neighbor's solar panels between 10am and 2pm, peak hours for collecting sunlight. The judge ruled in favor of Vargas, although he decided against fining Treanor and Bissett the up to $1,000 a day in violations allowed by the law.


Treanor and Bissett's argument? Their trees were in the ground before Vargas began construction on his panels. (Existing trees are exempt, but new growth is subject to the law.) Plus, the trees help the environment the old fashioned way by absorbing carbon dioxide, cooling the surrounding air and providing a habitat for wildlife. The couple isn't against green energy solutions?they drive a Prius?but they hope that lawmakers revise the law in a way that's fair for all parties. (And soon: Thanks to California's recent boom in solar power construction, more than 30,000 homes and businesses sported rooftop solar panels in 2007.) After all, how eco-friendly is solar power if you have to chop down trees to make it work?

lol I love this. Use solar power - I'm eco-friendly! No, save the trees, I'm more eco-friendly than you!

Vargas is right. There's plenty of trees, and the impact of him using solar power is much greater than a few trees. Of course I'd encourage better planning in the future. As long as they use the trees for something useful nobody should complain, people still use wood.

It's not like you can replant redwoods away from where they're unwanted. Can the guy not arrange his solar panels elsewhere? Can the couple not get their trees trimmed? Maybe they should work together to a) clean up the trees a little bit so the guy can get sunlight and b) install carbon scrubbers to replace the trees they're cutting down. If I'm correct in understanding (the east doesn't really have redwoods) redwoods are pretty big trees, no? That's a pretty decent amount of co2 scrubbing and oxygen replenishment, as well as natural shade that will keep houses cooler than the most efficient air conditioner in the summer. One tree (or eight) might not really make that much of a difference in terms of global climate quality or even regional climate quality, but without drastically scaling back carbon pollution, we really shouldn't be cutting down trees willy-nilly without doing something to make back the loss.

Sorry if I come across as a bit hippy. I just don't think redwoods should be cut down just for one person's solar panels - even though they were pretty expensive.

I wish Solar Panels didn't require so much space to power just one home. Maybe someday that'll be remedied.
I'm erring on the side of the Redwoods myself. They've got seniority. ;)

haha, this is very interesting, and it is in my opinion that Solar Panel > Tree, in this day and age.

If the tree was there before the panels, then forget it. I say leave the trees.
